1. About Modernza

Modernza is an online e-commerce store offering clothing and other products, including products manufactured and fulfilled through third-party print-on-demand and fulfillment partners.

Our products may be produced after an order is placed and shipped directly to the customer through our fulfillment partners.

We reserve the right to modify, suspend, or discontinue any product, service, or part of our website at any time.

2. Eligibility

By using our website, you confirm that you are legally capable of entering into a binding agreement under applicable Indian law.

You agree to provide accurate, current, and complete information when placing an order or creating an account.

3. Products

Modernza makes reasonable efforts to ensure that product descriptions, photographs, colors, measurements, and other information are accurate.

However, actual colors may vary depending on your device, screen settings, lighting, and the manufacturing or printing process.

Because our products may be produced on demand, minor variations in print positioning, color, or appearance may occur.

Please carefully review the product description and size chart before placing your order.

4. Orders

When you place an order through our website, you are requesting to purchase the selected products.

After successful payment or order confirmation, you may receive an order confirmation by email or other communication method.

Modernza reserves the right to cancel or refuse an order where reasonably necessary, including in cases of:

• Payment failure

• Incorrect or incomplete customer information

• Suspected fraud

• Pricing or product listing errors

• Fulfillment problems

• Unavailability of a product

• Violation of these Terms

If we cancel an order after receiving payment, an eligible refund will be processed.

5. Made-to-Order Products

Many Modernza products are produced specifically after an order is placed.

For this reason, we generally cannot accept cancellations, returns, or exchanges simply because a customer changes their mind, orders the wrong size, or no longer wants the product once production has started.

Customers are encouraged to review product details and size charts carefully before ordering.

6. Pricing and Payments

All prices displayed on our website are in Indian Rupees (INR), unless otherwise stated.

Prices may change without prior notice. The price applicable to your order will generally be the price displayed when the order is successfully placed.

Payments may be processed through third-party payment providers.

Modernza does not store complete payment card information on its own servers unless specifically stated.

7. Shipping and Delivery

Modernza uses third-party fulfillment and shipping partners to manufacture, process, and deliver orders.

Orders are generally processed within the applicable fulfillment timeframe, after which delivery time depends on the destination, courier, and serviceability of the delivery address.

Delivery dates are estimates and are not guaranteed.

Modernza is not responsible for delays caused by:

• Courier or logistics providers

• Incorrect addresses

• Incorrect contact information

• Customer unavailability

• Unserviceable locations

• Weather conditions

• Natural disasters

• Strikes

• Government restrictions

• Technical problems

• Other circumstances beyond our reasonable control

Customers are responsible for providing an accurate and complete delivery address.

8. Return-to-Origin (RTO)

An order may become RTO when delivery cannot be completed.

Examples include:

• Customer refusing delivery

• Customer being unavailable

• Incorrect address

• Incorrect phone number

• Customer not responding to the courier

• COD payment not being available

• Unserviceable delivery location

Additional shipping or handling charges may apply if an RTO order needs to be reshipped due to circumstances attributable to the customer.

9. Returns and Exchanges

Because many Modernza products are made to order, we generally do not accept returns or exchanges for:

• Incorrect size selected by the customer

• Change of mind

• Personal preference

• Incorrect color selected

• Product no longer being wanted

• Minor variations inherent to the manufacturing or printing process

Please use the size chart provided on the product page before ordering.

10. Damaged, Defective, or Incorrect Products

If you receive a product that is damaged, defective, incorrectly printed, or incorrectly fulfilled, please contact Modernza as soon as possible and within 7 days of delivery.

You may be required to provide:

• Order number

• Clear photographs of the product

• Photographs of the packaging

• Unboxing video, where available

• Description of the issue

If the issue is verified, Modernza may provide an appropriate replacement or refund.

Claims submitted outside the applicable claim period may not be accepted.

11. Refunds

Eligible refunds will be processed after the relevant issue has been reviewed and approved.

Refunds may be issued to the original payment method or through another appropriate method where necessary.

Shipping charges may not be refundable unless the issue resulted from an error attributable to Modernza.

Refund processing time may depend on the payment provider or financial institution.

12. Order Cancellation

Because products may enter production shortly after an order is received, cancellation may not be possible once production or processing has started.

If an order has not yet entered processing, Modernza may, at its discretion, allow cancellation.

Where an eligible cancellation is approved, the applicable refund will be processed.

13. Intellectual Property

All Modernza trademarks, logos, designs, graphics, photographs, written content, website materials, and other original content are owned by or licensed to Modernza unless otherwise stated.

You may not copy, reproduce, modify, distribute, publish, sell, or commercially exploit our content without prior written permission.

14. Customer-Submitted Content

If you submit designs, images, text, or other content to Modernza, you confirm that you have the necessary rights and permissions to use that content.

You must not submit content that infringes another person's copyright, trademark, privacy, publicity, or other legal rights.

Modernza reserves the right to reject content that we believe may violate applicable laws or third-party rights.

15. Prohibited Activities

You agree not to:

• Use our website for unlawful purposes

• Submit fraudulent orders

• Attempt unauthorized access to our website or systems

• Abuse refunds, discounts, or promotions

Modernza is not responsible for delays or failures caused by events outside our reasonable control.

Modernza will not be responsible for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, wars, government restrictions, transportation disruptions, courier disruptions, internet failures, or other unforeseen events.
